Terms of Service

Effective date: 13 July 2026  |  Applies to: the NivaSetu mobile app (Android/iOS) and the NivaSetu Web Admin Portal

These Terms of Service ("Terms") govern your access to and use of the NivaSetu platform ("the App", "the Service"), operated by Karthik Hirenarti ("we", "us", "the Operator"). By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What the Service Is

NivaSetu is a multi-tenant residential society management platform used by housing societies to manage residents, families, visitors, complaints, notices, polls, amenity bookings, maintenance dues, and society accounting. It is provided to a society's residents and staff by that society's management committee, who determine who may register and what role each user has (Super Admin, Society Manager, Wing Secretary, Accountant, Security Guard, Service Staff, Resident).

2. Eligibility & Accounts

• You must be at least 18 years old to independently register and hold an account. Minors are represented in the App only as family members added by an adult head of family, as described in our Privacy Policy.
• You are responsible for keeping your login credentials confidential and for all activity under your account. Notify us or your Society Manager immediately if you suspect unauthorized use of your account.
• Registration for a specific society requires a valid Society Code issued by that society's management. New Resident and Society Manager sign-ups are subject to approval by existing staff/admins before the account becomes active.
• An account's status (Pending, Active, Suspended, Locked, Rejected, or Lease Expired) determines what access it has. We and your society's management may suspend or lock an account to protect the security or integrity of the Service.

3. Acceptable Use

You agree not to:

• Submit false, fraudulent, or misleading information — including fabricated visitor entries, falsified payment transaction references (UTRs), or fake KYC documents.
• Attempt to access data, accounts, or areas of the Service you are not authorized to access, or attempt to circumvent role-based access controls.
• Use the complaint, poll, notice, or messaging features to harass, defame, or abuse other users.
• Upload content that is unlawful, infringes another person's rights, or that you do not have the right to upload (e.g., another person's ID documents without their consent).
• Interfere with or disrupt the Service, attempt to reverse-engineer it, or use automated means to access it without our permission.

We and your society's management reserve the right to suspend or terminate accounts that violate these Terms.

4. Payments & Financial Data

• Maintenance dues and amenity fees are paid directly by residents to the society's own UPI ID, via any UPI-enabled app of the resident's choice. The App only displays the amount due and records the transaction reference (UTR) you submit, so your society's staff can verify the payment against their bank statement.
• Disputes about a payment, refund, or due amount are between you and your society's management; the Operator is not a party to, and is not liable for, such disputes.
• The Finance & Accounting module (chart of accounts, ledgers, vendor bills, budgets, reports) reflects records entered by your society's Accountant/management and is provided as a bookkeeping tool. It does not constitute financial, tax, or legal advice, and the Operator is not responsible for the accuracy of records your society's staff enter.

5. Your Content

You retain ownership of the content you submit (profile information, documents, complaint text and photos, poll responses, etc.). By submitting content, you grant us a limited license to store, process, and display it as necessary to operate the Service for your society, as described in our Privacy Policy. You are responsible for the accuracy and lawfulness of content you submit, including that you have any necessary consent to upload another person's information (e.g., a family member's or visitor's details).

6. Third-Party Services

The Service runs on infrastructure we operate directly on a server located in India, and also relies on a small number of third-party services — including Google Firebase (sign-in and push notifications), a self-hosted WhatsApp gateway, and email delivery — described in our Privacy Policy. We are not responsible for outages or issues originating from third-party providers that are outside our reasonable control.

7. Availability & Changes to the Service

We aim to keep the Service available and reliable but do not guarantee uninterrupted or error-free operation. Features may be added, changed, or removed, and a Super Admin may place a society into Maintenance Mode (temporarily restricting non-admin access) for upgrades or data corrections. The Service is provided "as is" and "as available," without warranties of any kind, to the fullest extent permitted by law.

8. Limitation of Liability

To the fullest extent permitted by applicable law, the Operator shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to loss of data, loss of funds due to a payment made outside the App, or disputes between you and your society's management or other residents. The Operator's total liability for any claim arising from the Service shall not exceed the amount (if any) you paid us directly for the Service in the preceding 12 months.

9. Indemnification

You agree to indemnify and hold the Operator harmless from any claims, damages, or expenses arising from your violation of these Terms, misuse of the Service, or content you submit that infringes another person's rights.

10. Termination

You may stop using the Service at any time. See our Account & Data Deletion page to request deletion of your account and associated data. We or your society's management may suspend or terminate your access if you violate these Terms, at the request of your society's management committee, or if your residency/tenancy at the society ends.

11. Intellectual Property

The NivaSetu name, design, and underlying software are the property of the Operator (or its licensors) and are protected by applicable intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or source code beyond what is necessary to use the Service as intended.

12. Changes to These Terms

We may update these Terms from time to time. We will update the "Effective date" above and, for material changes, notify users in-app or via email/WhatsApp. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of India. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the competent courts of India.
